ADULT WAIVER/RELEASE FORM

BY SIGNING THIS, YOU ARE RELEASING AND WAIVING LEGAL RIGHTS.

PLEASE READ CAREFULLY

I recognize and accept that the sports and other athletic activities have inherent risks, and that participation in such activities can result in property damage, personal injury and/or death. I represent and warrant that I have no health problems or physical limitations that would make me unable to participate in sports and other athletic activities at THE BATTING CLUB, Batting Club LLC, or that would result in such participation being medically contraindicated.

In consideration of the privilege of participating in any way at the THE BATTING CLUB, Batting club LLC, related events and activities, I, acknowledge, understand, appreciate, and agree that:

The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

I, on behalf of myself my executors, administrators, personal representatives, heirs and assigns, do hereby and forever release, acquit and discharge, and covenant to indemnify and hold harmless, THE BATTING CLUB, Batting Club, LLC, their owners, managers, employees, agents and staff from any and all actions, causes of action, claims, crossclaims, third party claims, and demands, including those for property damage, personal injury, death, and loss of consortium, on account of or in any way growing out my participation in sports and athletic and other activities in and around THE BATTING CLUB, Batting Club, LLC to the fullest extent permitted by law.

I accept and acknowledge that Batting Club LLC has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19 and that Batting Club LLC cannot guarantee that I will not become infected with the Coronavirus/Covid-19.

I attest that:

  • * I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
  • * I have not traveled internationally within the last 14 days.
  • * I have not traveled to a highly impacted area within the United States of America in the last 14 days.
  • * I am following all CDC/ state-mandated guidelines that prevent me from visiting public places.

    I understand and accept that participating in sports and athletic activities at The Batting Club involves inherent risks, including property damage, personal injury, and even death. I confirm that I have no health conditions or physical limitations that would prevent safe participation in these activities.

    By engaging in activities at The Batting Club, I willingly assume all risks, both known and unknown, and take full responsibility for my involvement. I agree to comply with all rules and notify staff if any hazards are observed.

    Furthermore, I, on behalf of myself and my representatives, release and hold harmless The Batting Club, its owners, employees, and agents from any claims or liabilities arising from my participation to the fullest extent permitted by law.
